The Case of Kenneth Foster: Texas Prepares to Execute Man for Driving a Car Near Scene of Murder Three weeks from today, a 30-year-old African American man on death row in Texas is scheduled to be executed. Kenneth Foster was sentenced to death ten years ago for the murder of Michael LaHood, a white man. The trial judge, the prosecutor, and the jury that sentenced him to die admit he never killed anyone. Foster is scheduled to be executed under a controversial Texan law known as the law of parties. The law imposes the death penalty on anybody involved in a crime where a murder occurred. In Foster's case he was driving a car with three passengers, one of whom left the car, got into an altercation and shot LaHood dead. We broadcast a rare interview of Kenneth Foster from death row and speak to his family in Texas as well a journalist who has closely followed his case.

I think that this is dissimulation on Gov. Perry's part. The law of parties statute is a bad statute, and should not be used to condemn any person to a death sentence. If Governor Perry would immediately commute to life imprisonment every prisoner on death row convicted under the law of parties statute, he'd be making a significant statement a majority of Texans will understand.

Sounds like to me that Gov Perry knew all along that he would commute the sentence as he expressed concern that it was allowed that Foster could be tried along side the trigger man and wants the state legislatures to look at this law.

Why becase we can't forsee the future let alone the next minute. No one is saying this guy was an angel but he was not guilty of shooting anyone and in reading the transcripts or interviews one would see this! Hence the reason why Gov Perry commuted the sentence to life and took on the reccommendation from the parole board!!
